At the time, the federal government held Lincoln’s legal theory to be good enough for the federal government to

1. declare secession to be “treason” against a single nation,

2. invade the states with Total War, and

3. kill over 1/4 million people,

they can no longer stand by Lincoln’s arguments, in validating their claims of national authority.

Rather, the now simply dance around the issue, while clinging to their claim of final authority…. based on NOTHING.
